TERMS AND CONDITIONS

Welcome to Creators HQ. These Terms and Conditions (“Terms”) govern your access to and use of the Creators HQ website, application, and landing pages (collectively, the “Site”), as well as your application to participate in the Amazon Creators Foundry Programme (the “Programme”) facilitated by Creators HQ LLC (“Creators HQ”, “CHQ”, “we”, “us”, or “our”).

By submitting an application form on this Site, you (“Applicant”, “Creator”, or “you”) acknowledge that you have read, understood, and agreed to be bound by these Terms in full upon submission.

1.Scope of Application

1.1Creators HQ operates solely as a talent incubator and referral partner for the Programme. Submitting an application on this Site constitutes an expression of interest to be evaluated by Creators HQ for potential referral to Souq.com FZ LLC or its affiliates (“Amazon”).

1.2Submission of an application does not guarantee that you will be selected, referred to Amazon, or accepted into the Programme. Referral decisions remain at the sole and absolute discretion of Creators HQ.

1.3If Creators HQ elects to refer you to Amazon and you are onboarded and accepted as sellers on Amazon’s marketplace through the Programme, any subsequent relationship, onboarding process, contract, storefront activity, or agreement is strictly and exclusively between you and Amazon.

Creators HQ is not a party to any contract or agreement between you and Amazon, and Creators HQ assumes zero responsibility, liability, or obligation for whatever occurs between you and Amazon once you are onboarded and accepted as sellers on Amazon’s marketplace through the Programme (including, but not limited to, marketplace access, storefront performance, account suspension, sales commissions, payouts, or Amazon disputes).

You acknowledge and agree that users, shoppers, or consumers interacting with your Amazon referral links or storefront are customers of Amazon, not Creators HQ.

2.Application Process & Vetting

2.1Upon receiving your completed application, Creators HQ will conduct an initial vetting and review process. Creators HQ reserves the right to contact you via email or messaging channels to request additional information, social analytics, or content samples as part of this evaluation.

2.2You warrant that all social media handles, contact information, personal details, and metrics submitted in your application form are accurate, current, and truthful. Supplying false or misleading information will result in immediate disqualification.

3.Eligibility, UAE Regulatory Compliance & Golden Visa Nominations

3.1Applicants under the age of eighteen (18) years must obtain prior written consent from a parent or legal guardian to submit an application and participate in the Programme.

3.2Any application submitted by a Minor Applicant without valid, verifiable parent or legal guardian consent will not be considered, evaluated, or referred to Amazon, and Creators HQ reserves the right to immediately reject or disqualify any such submission.

3.3To apply, you must be a content creator residing in, or intending to relocate to, the United Arab Emirates, operating active social media channels, and complying with all applicable UAE laws, National Media Council (NMC) / UAE Media Council guidelines, and advertising regulations.

3.4You acknowledge that operating as a commercial content creator or participating in e-commerce programs in the UAE requires appropriate commercial registrations or trade licenses. If you are selected and referred, obtaining and maintaining valid commercial permits remains your sole responsibility, though CHQ and its ecosystem partners may offer guidance during onboarding.

3.5Golden Visa Nominations:

You explicitly acknowledge and agree that Creators HQ’s role is strictly limited to submitting a nomination. Creators HQ is not a government authority, immigration agency, or visa issuing body.

Submission of a nomination by Creators HQ does not guarantee approval, processing timelines, or visa issuance by UAE government authorities. Final authority for Golden Visa approvals rests exclusively with the relevant UAE immigration and government authorities. Creators HQ assumes zero liability, obligation, or financial responsibility for rejected, delayed, or cancelled visa applications, or for any relocation costs incurred by the Creator.

4.Data Sharing & Program Metrics Consent

4.1By submitting your application, you authorize Creators HQ to process your application details and share your contact information, social handles, and portfolio details with Amazon, the Department of Economy and Tourism (DET), immigration bodies (where applicable for visa nominations), and designated Service Provider Network (SPN) partners for screening and onboarding facilitation.

4.2If you are successfully referred and onboarded into the Programme by Amazon, Creators HQ may request you to share your storefront performance metrics (including traffic, conversion rates, catalog listings, and revenue metrics) for impact tracking, program evaluation, and strategic support.

5.Intellectual Property & Media Consent

5.1You retain full ownership of your personal brand, trademarks, and pre-existing social media content.

5.2By participating in Programme workshops, events, or publicity opportunities organized by CHQ, you grant Creators HQ a non-exclusive, royalty-free license to use your name, social media handle, workshop photos/videos, and submitted testimonials for PR, case studies, website showcases, and social media promotion.

6.Traffic Integrity & Prohibited Practices

Applicants and referred creators shall not engage in deceptive marketing practices, including using automated bots, web-scraping software, paid keyword bidding on protected trademarks, or deceptive traffic generation methods. Any application or referral found to involve fraudulent or automated traffic will be immediately rejected and disqualified.

7.Disclaimers, Limitation of Liability & Governing Law

7.1The Site and application process are provided on an "as-is" and "as-available" basis. Creators HQ makes no warranties regarding application outcome, referral timeline, visa issuance, or potential earnings.

7.2To the maximum extent permitted by UAE law, Creators HQ shall not be liable for any indirect, special, incidental, or consequential damages, or for any issues arising out of your interactions with UAE immigration authorities. CHQ’s total cumulative liability for any claim related to your use of this Site or application form shall not exceed AED 500.

7.3Governing Law & Jurisdiction: These Terms shall be governed by, and construed in accordance with, the federal laws of the United Arab Emirates and the local laws applicable in the Emirate of Dubai. The parties irrevocably submit to the exclusive jurisdiction of the Dubai Courts for the resolution of any dispute, controversy, or claim arising out of or in connection with these Terms or your application.
