1. Introduction

Welcome to Creators HQ (“CHQ”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, mobile applications, facilities, services, programs, and any other offerings operated or managed by CHQ (collectively, the “Services”).
By accessing or using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, please refrain from using the Services.

2. Definitions

In these Terms, the following expressions have the meanings given below:

• “Member”: any person or entity accepted into CHQ’s membership program and granted access to CHQ’s Services.
• “Creator”: a Member engaged in digital media, creative, or content-related activities.
• “Enabler”: a Member or partner providing services or support to creators.
• “Studio”: CHQ’s physical production, podcast, or creative spaces available for booking and use.
• “Third-Party Services”: any services, tools, or platforms provided by independent parties, whether or not integrated or recommended by CHQ.
• “Golden Visa Services”: nomination assistance, document preparation, and advisory support provided by CHQ for visa applications under the UAE’s Golden Visa program.
• “Website”: the official CHQ website available at https://creatorshq.com.
• “Force Majeure Event”: any event beyond the reasonable control of CHQ, including but not limited to governmental actions, delays, internet outages, pandemics, or natural disasters.

3. Scope of Services

CHQ provides a range of creative, educational, and business-support Services, including:

• Studio and workspace facilities;
• Workshops, mentorship programs, and creator bootcamps;
• Golden Visa nomination and relocation support;
• Consultation and advisory sessions with platform representatives;
• Assistance with permits, licenses, and compliance;
• Access to events, networking, and business opportunities;
• Membership benefits such as priority booking, discounted rates, exclusive content, and complimentary 1 Billion Followers Summit ticket for CHQ Premium members who maintain an active membership at the time of the summit or during any discounted rate event.

Certain Services may require separate agreements, applications, or additional terms, which will prevail in case of conflict.

4. Membership Eligibility and Application

4.1 Eligibility. Membership is open to individuals aged 18 and above or entities legally registered under applicable UAE law.

4.2 Application. Applicants must submit accurate personal and professional details. CHQ reserves the right to accept or reject applications at its discretion.

4.3 Membership Period. Memberships are issued on an annual or monthly basis, renewable subject to payment and compliance with these Terms.

4.4 Non-Transferability. Memberships are personal and cannot be transferred, shared, or resold.

5. Fees, Payments, and Renewals

5.1 Membership Fees. Membership fees and other charges are displayed on our website or communicated in writing.

5.2 Billing & Renewals. Memberships automatically renew at the end of each billing cycle unless cancelled by written notice submitted at least thirty (30) days prior to the renewal date. Notwithstanding the foregoing, in the event that an automatic renewal occurs, the Member may request the cancellation of such renewal and a full refund of the fees charged in respect of the renewed period, provided that: (i) the request is submitted prior to the expiry of the tenth (10th) day following the renewal date; and (ii) the Member has not utilised any of the CHQ's services or facilities during the period commencing on the renewal date and ending on the date of the cancellation request. For the avoidance of doubt, any use of the CHQ's services or facilities prior to the submission of the cancellation request shall be deemed acceptance of the renewal, and the Member shall thereupon forfeit the right to request a refund, with the renewal being treated as binding and fully effective from the renewal date.

5.3 Payment Methods. Payments shall be made through accepted online payment gateways, credit/debit cards, or bank transfers.

5.4 Late Payments. Failure to pay within 10 days of due date may result in suspension of access or cancellation of membership.

5.5 Taxes. All fees are exclusive of applicable VAT or taxes, which will be added as required under UAE law.

6. Refund & Cancellation Policy

6.1 No Refund Policy. All membership fees are non-refundable, whether paid in full or in installments, except where expressly approved by CHQ in writing.

6.2 Workshops & Programs. Cancellations for workshops or programs made more than 7 days before the start date may be eligible for rescheduling or credit at CHQ’s discretion.

6.3 Visa & Licensing Services. Fees related to Golden Visa, permits, or other administrative support are strictly non-refundable, regardless of application outcomes.

6.4 Event Cancellations. CHQ reserves the right to cancel or reschedule events or programs. In such cases, Members will be offered a credit or reschedule option.

7. Studio, Facility & Workspace Use

7.1 Access & Booking. Members must reserve spaces through CHQ’s booking system. Access is permitted only during confirmed booking periods.

7.2 Operating Hours. Facilities are available between 9:00 AM – 6:00 PM (Monday to Friday). Weekend access may be subject to prior approval and availability.

7.3 Operator Availability. Technical or on-site operator support is limited to standard business hours. No assistance is provided after hours or on weekends.

7.4 Conduct & Cleanliness. Members must maintain cleanliness, follow safety protocols, and treat equipment responsibly.

7.5 Damages. Members are liable for any damage caused to facilities or equipment due to negligence or misuse.

7.6 Prohibited Activities. Illegal, defamatory, or hazardous activities are strictly forbidden within CHQ premises.

8. Golden Visa Services

8.1 Service Description. CHQ provides document review, nomination facilitation, and submission support for UAE Golden Visa applications.

8.2 Processing takes 8–12 weeks, starting from the date you receive the nomination email from Creators HQ.

8.3 Government Delays & Liability. CHQ is not responsible for delays, rejections, or procedural changes by UAE authorities.

8.4 Accuracy of Information. Applicants are responsible for providing accurate and complete documentation.

8.5 No Guarantee. Visa approvals remain the sole discretion of UAE government entities. CHQ does not guarantee approval under any circumstances.

9. Third-Party Services & Partners

9.1 CHQ may collaborate with third-party vendors, agencies, or consultants. These entities operate independently, and CHQ bears no responsibility for their performance or conduct.

9.2 Members’ dealings with third parties are at their own risk. CHQ disclaims any liability for damages, loss, or dissatisfaction arising from such services.

10. Intellectual Property & Content Rights

10.1 Ownership. All materials, branding, and content on CHQ’s platforms are owned or licensed by CHQ. Members shall not reproduce or exploit such content without prior written consent.

10.2 User-Generated Content. Members grant CHQ a non-exclusive, royalty-free, worldwide license to use, reproduce, and promote any content created during CHQ workshops, programs, or on CHQ premises, for marketing and archival purposes.

10.3 Moral Rights. CHQ will credit creators appropriately when content is used publicly, unless anonymity is requested in writing.

10.4 Prohibited Content. Users may not upload or create content that is defamatory, obscene, or violates intellectual property laws.

11. Liability & Indemnity

11.1 Limitation of Liability. To the fullest extent permitted by law, CHQ’s total liability for any claim shall not exceed the total membership fees paid by the Member in the preceding six (6) months.

11.2 Exclusion of Damages. CHQ shall not be liable for indirect, incidental, or consequential damages, including data loss or loss of profits.

11.3 Indemnity. Members agree to indemnify and hold harmless CHQ, its affiliates, and staff from any claims, damages, or costs arising from their misuse of the Services or breach of these Terms.

12. Use of CHQ Brand and Identity

12.1 You may not use CHQ’s logos, trademarks, branding elements, or claim any form of partnership, endorsement, or association with CHQ without prior written approval from CHQ.

12.2 CHQ reserves the right, at its sole discretion, to request the removal or discontinuation of any content, post, or material that misrepresents CHQ, its partners, or could adversely affect CHQ’s reputation or public image. The Member or user shall comply with such a request promptly and without objection.

13. Force Majeure

CHQ shall not be liable for any delay or failure to perform due to a Force Majeure Event, including government actions, system outages, pandemics, natural disasters, or supply chain disruptions. Performance obligations shall be suspended for the duration of the event, and timelines extended accordingly.

14. Taxes, Permits & Legal Compliance

14.1 Members are solely responsible for compliance with all applicable VAT, corporate tax, or regulatory obligations within their jurisdiction.

14.2 CHQ shall not be responsible for any penalties, interest, or legal consequences resulting from non-compliance by Members or Enablers.

15. Privacy & Data Protection

CHQ processes personal information in accordance with the UAE Federal Decree-Law No. 45 of 2021 on Data Protection and other applicable laws.

16. Dispute Resolution & Governing Law

16.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, specifically the Emirate of Dubai.

16.2 Dispute Resolution. Parties shall first attempt to resolve disputes amicably. If unresolved, disputes shall be subject to the exclusive jurisdiction of the Dubai Courts.

16.3 CHQ reserves the right to pursue equitable relief in any jurisdiction for infringement or misuse of intellectual property.

17. Termination & Suspension

17.1 CHQ may suspend or terminate membership or access if the Member violates these Terms, fails to pay fees, or engages in misconduct.

17.2 Upon termination, all rights to access CHQ’s facilities and digital platforms cease immediately.

17.3 CHQ may delete or retain Member data in accordance with applicable laws and internal policies.

18. Amendments

CHQ reserves the right to update or modify these Terms at any time. The updated version will be posted on the Website and will take effect immediately upon publication.

Continued use of the Services after any update constitutes acceptance of the revised Terms.

20. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between CHQ and the Member.
• Severability: If any provision is held invalid, the remaining terms shall remain enforceable.
• Waiver: Failure to enforce any right shall not constitute a waiver of that right.
• Assignment: Members may not assign or transfer rights under these Terms without CHQ’s consent.
